These Terms govern access to ophir.solutions and contractor-branded estimating tools powered by Ophir. By checking the acceptance box and submitting information through an estimator, you agree to these Terms. If you do not agree, do not submit the form. The contractor identified on an estimator page is a separate business and is not Ophir's employee, agent, partner, or franchisee.
PLANNING ESTIMATES ONLY
The Service uses information you provide and pricing, equipment, assumptions, and business rules supplied or approved by the Participating Contractor to produce a preliminary planning estimate. It is not a Manual J or other load calculation, engineering analysis, diagnosis, inspection, bid, appraisal, offer, warranty, or final quote. It cannot identify all site conditions.
Final equipment selection, sizing, eligibility, scope, permits, code requirements, taxes, rebates, availability, warranties, financing, and price require the Participating Contractor's on-site evaluation and a separate written proposal. Estimates may change because of electrical, gas, ductwork, structural or access conditions; asbestos, mold, lead, or other hazardous materials; code upgrades; equipment availability; utility or manufacturer rules; inaccurate user information; or other site-specific conditions.
No HVAC purchase, installation, financing, or service contract is formed through the Service, including when you click “Request On-Site Evaluation.” Any later contract is solely between you and the Participating Contractor.
OPHIR'S LIMITED ROLE
Ophir supplies software. Ophir does not sell, size, finance, manufacture, inspect, install, maintain, repair, or warrant HVAC equipment or services. Ophir does not control the Participating Contractor's work, prices, scheduling, communications, licenses, insurance, financing, representations, or customer service. Display of a contractor, brand, model, logo, badge, warranty, rating, or financing program does not mean Ophir or a manufacturer endorses, guarantees, or certifies it.
The Participating Contractor is responsible for verifying its licenses, permits, insurance, proposal, disclosures, cancellation notices, lien notices, and performance. You should independently verify a contractor and review its written contract before buying.
Eligibility and acceptable use
You must be at least 18 years old and able to enter a binding agreement. The Service is intended for U.S. residents seeking information for a property they own or are authorized to address. You agree to provide accurate information and not to:
- probe, disrupt, overload, scrape, reverse engineer, or bypass security or access controls;
- submit another person's information without authority;
- use the Service for competitive data collection, resale, spam, fraud, or unlawful activity;
- upload malicious code or infringing, deceptive, or harmful content; or
- misrepresent identity, property, contractor status, or consent.
We may limit or suspend access to protect the Service, users, or others.
Communications and privacy
When you submit an estimate request, you authorize Ophir and the named Participating Contractor to use the information to prepare and deliver the estimate and respond to your request by email or telephone.
Marketing texts, prerecorded/artificial/AI-voice calls, or automated dialing require any separate consent shown to you; such consent is not a condition of receiving an estimate or buying services. You may revoke marketing consent by the method given in the message, including replying STOP to texts, but revocation does not affect communications already sent lawfully or necessary transactional communications.
Our Privacy Notice explains how information is handled. Your information will be shared with the specific Participating Contractor whose estimator you use. The contractor's own privacy practices may also apply after it receives the information.
Manufacturer, contractor, and site content
Names, logos, photographs, product information, and other third-party content belong to their respective owners. You receive no right to copy or use them except as needed to view the Service. Product depictions may differ from installed products. Availability, specifications, efficiency ratings, eligibility, and warranties must be confirmed in the contractor's final proposal and applicable manufacturer materials.
Ophir and its licensors own the Service, software, design, and Ophir content. Subject to these Terms, Ophir grants you a limited, personal, revocable, nonexclusive, nontransferable right to use the Service for its intended purpose.
Third-party services
The Service may link to a contractor, manufacturer, utility, financing provider, or other third party. Third parties have their own terms and privacy practices. Ophir is not responsible for their sites, decisions, products, or services. A link is not an endorsement.
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL ESTIMATES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” OPHIR DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND RESULTS. OPHIR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT AN ESTIMATE OR CONTRACTOR WILL MEET YOUR NEEDS.
Some jurisdictions do not permit some disclaimers, so they apply only to the extent permitted. Nothing in these Terms waives a right that cannot lawfully be waived.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPHIR AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS OR DATA; PROPERTY DAMAGE; PERSONAL INJURY; OR CLAIMS ARISING FROM A PARTICIPATING CONTRACTOR, EQUIPMENT, INSTALLATION, FINANCING, OR THIRD-PARTY SERVICE.
Disputes and governing law
Before filing a claim, you and Ophir agree to send a written description and requested resolution to the contact above and allow 30 days for an informal resolution, except for small-claims matters or urgent injunctive relief. These Terms are governed by Idaho law, without regard to conflicts rules. Subject to applicable consumer law, exclusive venue is the state and federal courts in Ada County, Idaho. You retain any non-waivable rights of your home jurisdiction.
Changes, availability, and termination
We may change the Service and these Terms prospectively. We will post the revised version and effective date and obtain new consent when required. Changes do not retroactively alter an existing claim. We may discontinue the Service. Sections intended by their nature to survive—including ownership, disclaimers, limitations, and disputes—survive termination.
General
These Terms and the Privacy Notice are the complete agreement between you and Ophir about consumer use of the Service. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder stays effective. Failure to enforce a term is not a waiver. You may not assign these Terms; Ophir may assign them in connection with a merger, financing, reorganization, or sale of the relevant business, subject to law.
